In Spain, there are several legal limitations that can block any procedure related to a vehicle. This is one of the most frequent causes of delays in buying or registering a car—especially in the second-hand market.

What Are Embargos, Seals and Liens

1. Embargo — Vehicle Seizure

It is a judicial or administrative retention of the car due to:

  • unpaid fines,
  • debts with the State,
  • tax defaults,
  • court rulings.

A car under embargo cannot be:

  • sold,
  • transferred,
  • registered or have ownership changed.

2. Seal — Circulation Prohibition

This is a stricter measure than an embargo. The vehicle may be retained or immobilized.

It applies in cases of:

  • serious tax debts,
  • legal proceedings,
  • severe infractions.

3. Liens (Financial and Legal Obligations)

These are obligations “linked” to the vehicle:

  • pending loans,
  • leasing or renting agreements,
  • debts with the owning company,
  • bank holds.

If the liens are not cleared, the car remains tied to the previous owner's obligations.

How These Limitations Affect the Buyer

Buying a car with restrictions carries the risk of:

  • not being able to register it,
  • not being able to transfer ownership,
  • assuming previous owner debts,
  • losing the vehicle if immobilized during a control.
